Justicable - Non Justicable Disputes

انصاف جوڳا - انصاف کان بالاتر جهڳڙا

بين الاقوامي قانون ۾ استعمال ٿيندڙ هن اصطلاح ذريعي، اهڙن جهڳڙن جي وچ ۾ فرق ظاهر ڪيو ويندو آهي، جن منجهان هڪڙا ٽياڪڙي (Arbitration) ۽ عدالتي حڪم (Adjudication) ذريعي حل ٿي سگهن ۽ ٻيا نه ٿي سگهن. هن اصطلاح منجهان بين الاقوامي قانون جي اختيار جي محدوديت ۽ عالمي جهڳڙن ۾ قانوني مداخلت ذريعي حل ٿي سگهندڙ ۽ ٻئي طرف سياسي ضد تي ٻڌل موقفن جي وچ ۾ سنڌا ظاهر ٿين ٿا. منجهانئن سياسي جهڳڙا اُهي آهن، جيڪي اعليٰ قانون مطابق حل ٿي سگهڻ جهڙا هوندا آهن، پر سگهاريون سياسي ڌريون پنهنجي قومي مُفادن جي ڪري اُنهن کي حل نه ٿيڻ ڏينديون آهن. قانوني مُداخلت ذريعي حل ٿيندڙ تڪرار سفارتڪاري، ٽياڪڙي، اثرائتين شخصيتن جي سرگرمين ۽ ٻه- رُخين يا ٽه- رخين ڳالهين ذريعي طئي ڪري سگهبا آهن، پر سياسي تڪرار ڌُرين جي طرفان ٿيندڙ انتهاپسنديءَ سبب حل نه ٿي سگهندا آهن
